{"id":33655,"date":"2025-08-09T13:49:26","date_gmt":"2025-08-09T13:49:26","guid":{"rendered":"https:\/\/usdailys.com\/?p=33655"},"modified":"2025-08-09T13:49:26","modified_gmt":"2025-08-09T13:49:26","slug":"emilie-kiser-wins-legal-battle-after-son-3-drowned-in-family-pool","status":"publish","type":"post","link":"https:\/\/usdailys.com\/?p=33655","title":{"rendered":"Emilie Kiser wins legal battle after son, 3, drowned in family pool"},"content":{"rendered":"<div id=\"main-content-blt66b7da401c6af509\" class=\"content-template_leftColumnInner__Du7BU\">\n<div class=\"content-template_body__RWRhb\">\n<div style=\"display: contents;\">\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p class=\"text_text__nEn66\"><strong>A judge has ruled in the favor of TikToker Emilie Kiser after she requested to block certain records about her three-year-old son&#8217;s death from the public. <\/strong><\/p>\n<p class=\"text_text__nEn66\">Kiser, an influencer online with over four million followers on <a class=\"anchor_link__6t7IO\" href=\"https:\/\/www.unilad.com\/TikTok\">TikTok<\/a>, has won the legal case she filed after her <a class=\"anchor_link__6t7IO\" href=\"https:\/\/www.unilad.com\/parenting\">son<\/a>, Trigg, fell into the swimming pool at their <a class=\"anchor_link__6t7IO\" href=\"https:\/\/www.unilad.com\/us-news\">Arizona<\/a> home and was sadly pronounced dead six days later.<\/p>\n<p class=\"text_text__nEn66\">Trigg initially fell into the pool on 12 May, with paramedics performing CPR on the toddler before he was taken to Chandler Regional <a class=\"anchor_link__6t7IO\" href=\"https:\/\/www.unilad.com\/health\">Hospital<\/a>.<\/p>\n<div class=\"floating-video-player_container__u4D9_\"><\/div>\n<p class=\"text_text__nEn66\">He was then transported via air to Phoenix Children\u2019s Hospital, before he passed away on May 18.<\/p>\n<p class=\"text_text__nEn66\">At the time, authorities also recommended that the influencer&#8217;s husband Brady face child abuse charges, though this was dropped two weeks ago by police.<\/p>\n<div class=\"article-image_articleImage__eyzAn\">\n<div class=\"article-image_imageWrapper__ANtPE\">\n<div class=\"resizable-image_wrapper__LRQlr\"><img decoding=\"async\" style=\"max-width: 100%; height: auto; display: block; margin: 1em auto;\" src=\"https:\/\/images.ladbible.com\/resize?type=webp&amp;quality=1&amp;width=3840&amp;fit=contain&amp;gravity=auto&amp;url=https:\/\/images.ladbiblegroup.com\/v3\/assets\/blt949ea8e16e463049\/blt7c4f4b795a06f11e\/689723f811daa35864974d37\/Emilie-Kiser-Brady-Kiser-Trigg-Theodore.png\" alt=\"Trigg, 3, passed away after falling into the pool (Emilie Kiser\/Instagram)\" data-chromatic=\"ignore\" data-nimg=\"fill\" \/><\/div>\n<\/div>\n<p><cite class=\"image-credit_imageCredit__YMlqS\">Trigg, 3, passed away after falling into the pool (Emilie Kiser\/Instagram)<\/cite><\/div>\n<p class=\"text_text__nEn66\">The father claimed to have lost sight of their son for up to five minutes while the couple tended to their newborn.<\/p>\n<p class=\"text_text__nEn66\">According to a Chandler Police Department report, Trigg was \u2018playing around the unsecured pool and unable to swim.\u2019<\/p>\n<p class=\"text_text__nEn66\">&#8220;It is clear from the video that he did not go into the water intentionally, rather, he tripped and fell in while playing with an inflatable chair,&#8221; the report claimed.<\/p>\n<p class=\"text_text__nEn66\">Trigg was in \u2018the backyard unsupervised for more than nine minutes\u2019, and the report states he was in the water for approximately seven minutes.<\/p>\n<p class=\"text_text__nEn66\"><a class=\"anchor_link__6t7IO\" href=\"https:\/\/www.unilad.com\/celebrity\/news\/emilie-kiser-lawsuit-trigg-toddler-drowns-928252-20250530\">Kiser filed a lawsuit on May 27<\/a> against Maricopa County public offices in a bid to protect the records regarding her son.<\/p>\n<p class=\"text_text__nEn66\">According <a class=\"anchor_link__6t7IO\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/tiktok-influencer-emilie-kiser-son-death-lawsuit-b2760902.html\" target=\"_blank\" rel=\"noopener\">to<\/a> The Independent, there were over 100 public record requests made with the city of Chandler and the Maricopa County Medical Examiner&#8217;s Office, which the suit called a &#8216;profound invasion of privacy&#8217; which would cause &#8216;irreparable harm&#8217; to Kiser\u2019s family.<\/p>\n<p class=\"text_text__nEn66\">Various municipal offices were named as defendants in the suit, such as the city of Chandler, the Chandler Police Department and Maricopa County.<\/p>\n<p class=\"text_text__nEn66\">Part of the lawsuit read: &#8220;Emilie and her family desperately want to grieve in private, but sadly, the public will not let them. News in a statement. &#8220;But they protect the dignity of a little boy whose memory should reflect the love and light he brought to the world.&#8221;<\/p>\n<p class=\"text_text__nEn66\">While Kiser\u2019s legal team said the redaction would help to prevent his death being used as content, particularly as it contains Trigg&#8217;s final moments and graphic details, Michael Kelley, an attorney for The Arizona Republic newspaper, said her filings would redact \u2018information and context that is critical to provide the public a reasonably full understanding of the investigation of the drowning, the police department&#8217;s decision to recommend criminal charges and the county attorney&#8217;s decision not to pursue criminal charges.\u2019<\/p>\n<p class=\"text_text__nEn66\">For now, this means that reporters and the public will be unable to know some of the details regarding Trigg.<\/p>\n<p class=\"text_text__nEn66\">\n<\/div>\n<p><cite class=\"image-credit_imageCredit__YMlqS\"><\/cite><\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; &nbsp; A judge has ruled in the favor of TikToker Emilie Kiser after she requested to block certain records about her three-year-old son&#8217;s death from the public.
